Dr. Said's Refusal to Give Records (Dec. 19, 2007)

To Dr. Freed c/o Richard Bennett, or to Richard Bennett while in charge during Freed's vacation:

1. WVMC told me they would obtain my records from Said from me because he has not/would not give them to me after I filled out a release form for them on October 29, 2007. I was told Freed said he'd get the records almost 3 weeks ago, and then right before Freed's vacation I was told WVMC was NOT going to get them for me. It had been 2 weeks since I had asked and was told they were being obtained. The very next day, Freed said WVMC WOULD get them for me but that I had to fill out a release form for Said to have them faxed. I filled out that form almost a week ago.

It has been almost 2 months and I do not have records from Said. WVMC told me they'd get them 3 weeks ago. Then, after 2 weeks passed, I was told I had to sign a form I could have signed 3 weeks ago. I need those records immediately.

Please let me know when they are available. Dr. Said is advised he is being reported to a medical board and HIPPA for refusal to abide by laws of ethics which has prevented me from obtaining new care.

2. WVMC has left me with zero pain medication that is effective. I told WVMC, weeks ago, that what they gave me did not work. WVMC did not refer me to a pain specialist or give me an open referral for one. Instead, they decided to punish me, without knowing my level of pain or having understanding of what works for me, and refused to supplement what I was given with even NON Narcotic pain relievers. Then, when I went through them more quickly, explaining I was attempting to find relief as they didn't work, and after I stated I couuld NOT take Neurontin as it didn't target my pain and only made me sleepy, I was told I was receiving nothing else. I am now completely OUT of pain medications of any kind and nothing over the counter works at all. I woke up last night, from sound sleep, 2 times again, and had to draw a hot bath and drink wine to find enough comfort to be able to go back to bed. I did not sleep well last night because of the pain. WVMC has all these warnings and reports from me, and they ignore them, which I believe is not only negligent but a violation of standard of care and even abusive. If I explain I am in distress because of pain, and refused any remedy for pain that is reasonable, such as a referral to a pain specialist, it is almost like intentional infliction of emotional distress.

I am OUT of pain medications. I am in pain. What you gave me did NOT work. What the reasonable course would have been would be to give me a referral to a pain specialist who has more experience in reasonable treatments for my pain. You have not done this. Perhaps you've not considered this. I am willing to give you the benefit of a doubt and ask you, today, for a referral to the "pain specialist of my choice". I cannot go to a pain specialist on my insurance without such a referral, and my last PCPs told me it would be good for me to go. So what's the hold up? As far as I know, it doesn't cost WVMC anything to write a referral. Does it???

I am expecting an answer no later than the end of the day today, December 19, 2007.
